Prof. Xue Gave Keynote Speech at APEC WORKSHOP ON ENHANCING REGULATORY INFRASTRUCTURE FOR E-COMMERCE

APEC Workshop on Enhancing Regulatory Infrastructure for E-Commerce was successfully held on October 11-12 in Hanoi, Vietnam. The Workshop aimed to identify the challenges, difficulties faced by the member economies in creating a favorable regulatory infrastructure e-commerce for business as well as updating e-commerce trends and issues arisen affecting the regional supply chain connectivity and institutional connectivity; share experiences, best practices from the APEC member economies especially from those economies that have developed e-commerce regulatory regimes and listen to voices of the private sectors to improve regulatory infrastructure; provide inputs for the implementation of the Phase II of  the SCFAP II; and make recommendations to APEC for further consideration and action if appropriately. Prof. Xue was invited as the Member of APEC Expert Council on e-Business Alliance to give a keynot speech on the Chinese E-Commerce Law and New Regulatory Environment. Officials from 21 APEC economies showed great interests in the Chinese new Law and raised many thoughtful questions. Prof. Xue explained the categories of e-commerce operators, responsibilities and liabilities of e-commerce platform operators in details to the audience. Prof. Xue also led the group discussion on the role of the  individual government and APEC to play for an enabling regulatory environment for e-commerce.

2018 Autumn Inaugurating International Expert Public Lecture 

Artificial Intelligence and the Right to be Forgotten

 

There is no better chance to celebrate the enactment of the China’s E-Commerce Law on August 31, 2018 with a Public Lecture dedicating to innovative legal issues, i.e. AI and Erasure Right. In the first part, Dr. Liu offers a brief introduction to artificial intelligence, followed by a discussion on potential legal and policy issues associated with artificial intelligence. Artificial intelligence that is poised to become the fourth industrial revolution, fundamentally changing the way we live, work, and learn. In the second part, Associate Professor Gehan Gunasekara examines the right to erasure (the so-called “right to be forgotten”) as it has taken shape in New Zealand both through common law and statutory developments. Focusing in particular on the Privacy Act 1993 he examines the connection between the need for erasure and related data privacy concerns, including the limits of correction, data quality and data retention limits. He argues that this bundle of rights is founded on respect for context and ought to be viewed as a societal right and not only an individual one. Finally, the presentation explores the special challenges arising from the digital sphere especially when information is linked or indexed online and hint at possible solutions. The BNU students, Chinese and international, enjoyed the lectures and interacted with the two experts actively.

2018年9月4日,北京师范大学互联网与法律研究中心、联合国国际贸易法委员会亚太中心与北京师范大学国际电子商务法联合认证项目主办的国际专家讲座在后主楼1922法学院学术报告厅成功举办。

讲座主题为“人工智能与被遗忘权”(Artificial Intelligence and the Right to be Forgotten),讲座专家为奥克兰大学商学院商法系高级讲师Benjamin Liu博士和奥克兰大学商学院商法系Gehan Gunasekara副教授。北京师范大学互联网政策与法律研究中心主任、联合国国际贸易法委员会亚太中心与北京师范大学国际电子商务法联合认证项目中方主任薛虹教授担任主持人与评议人。北师大法学院的十多位中外研究生以及留学生与访问、交换生参加了讲座,并与讲座专家进行了现场交流。

在第一部分中,Benjamin Liu博士简要介绍了人工智能,然后讨论了与人工智能相关的潜在法律和政策问题。人工智能有望成为第四次工业革命,从根本上改变我们的生活、工作和学习方式。在第二部分中,Gehan Gunasekara副教授将通过普通法和法定发展审查新西兰已经形成的擦除权(所谓的“被遗忘权”)。Gehan Gunasekara副教授特别关注1993年的隐私法案,研究擦除需求与相关数据隐私问题之间的关系,包括纠正限制,数据质量和数据保留限制。他讲到,建立在尊重背景的基础上的这一系列权利,应该被视为一种社会权利,而不仅仅是个人权利。此外,Gehan Gunasekara副教授探讨数字领域带来的特殊挑战,尤其是在线上链接或索引信息并提出了相应的解决方案。

最后,十多位中外研究生以及留学生与访问、交换生提出了富有价值的问题,并与Benjamin Liu博士、Gehan Gunasekara副教授进行了热烈的讨论。

Prof. Xue Addressed at the International Conference on Promoting Connectivity for an Inclusive Asia and the Pacific

International trade is a key driving force behind economic growth that since 1990 has listed more than a billion people out of poverty in Asia and the Pacific. However, in the years since the global financial crisis, trade growth has fallen behind GDP growth, after outpacing it for many decades. Despite early signs of a recovery in the growth of world trade, the global economic environment is still uncertain, and much remains to be done to realize potential trade outcomes for inclusive growth. The International Conference on Promoting Connectivity for an Inclusive Asia and the Pacific organized by Asia Development Bank (ADB) was held on June 27–28, 2018 in Tashkent, Uzbekistan.

Prof. Xue was invited by the ADB and UNESCAP to present “Facilitation of Digital Trade Laws, Measures and Recent Developments in China” under the theme “Overview of Trade Facilitation and Paperless Trade Implementation”. She gave a comprehensive overview on the legal issues related to the SW facilities, the role of e-commerce platform services and international cooperation in cross-border e-commerce. She also briefly introduced the Chinese new E-Commerce Law. Her presentation was well received by the Central Asia audience and responded to many questions.

薛虹教授在2018中国电子商务创新发展大会上接受记者专访

跨境电商蓬勃发展,然而纠纷也日益增多。遇到问题,消费者该怎么维权?北京师范大学法学院教授薛虹,在2018中国电子商务创新发展峰会上接受记者专访时说,跨境电商平台应建立健全争议解决机制,同时大力开展网上调解、网上仲裁等非讼争议解决制度。

“发生产品方面的纠纷去国外法院起诉,既耗时又费钱,不太可行。”同时,薛虹也认为中国消费者依照中国法律在中国法院起诉外国商家,再把法院裁决通过外交途径递送到当地执法机构的主张,也很“乌托邦”。

基于以上两种维权方法的不可行性,薛虹提出的第三个方法是,跨境电商平台应该负起责任,具体说就是“平台要建立一个相应的争议解决机制,最起码能够接受消费者的投诉,因为只有平台知道商家的信息。”同时,平台也可以建立保证金制度,“出现问题就可以用商家这个钱赔给消费者,或者建立一个先行赔付机制,如此种种,让消费者权利得到最大程度的保护。”

第四个方法就是大力开展非讼解决争议,比如网上调解、网上仲裁等。薛虹认为,这是一种超国家化的基于契约争议的解决制度,“前提是这个机制得建立起来,这在欧盟已经实现了。我们‘一带一路’沿线国家就可以建立这样的制度。”
