ADNDRC provides comprehensive online dispute resolution services for resolving domain name disputes, accredited by the Internet Corporation for Assigned Names and Numbers (ICANN) since 2002. ADNDRC DOMAIN NAME DISPUTE RESOLUTION PRACTICE DEVELOPMENT WORKSHOP 2.0 was held on 27-28 April 2023 in hybrid mode. On the top of Workshop 1.0, this Workshop explore the practical and legal complexities relating to proceedings under the Uniform Dispute Resolution Policy (UDRP), including concurrent litigation proceedings, case management by the ADNDRC, and the practitioner’s perspective.
Prof. Xue was invited to give a keynote speech on DNDRC Proceedings’ Substantive Issues on Day One. Prof. Xue primarily addressed the emerging issues regarding resolution of disputes involving new gTLDs, application of national laws in DRP proceedings and assessment of bad faith of domainers. Prof. Xue highlighted the special features of new gTLD disputes and how to apply the three key elements in these disputes. Prof. Xue’s presentation was highly regarded by all the audience and inspired the other panelists to make the relevant comments and cited the decisions made by Prof. Xue. The Worship was a huge success to the domain name community in AP region.

Topic: Contribution of Recent and Current UNCITRAL Work to Digital Trade
Dr. Luca Castellani is a legal officer in the Secretariat of the United Nations Commission on International Trade Law (UNCITRAL). After graduating in law in the University of Torino, he received a doctoral degree in comparative law from the University of Trieste and a master in international law from New York University. He joined the Office of Legal Affairs of the secretariat of the United Nations in 2001 and the UNCITRAL secretariat in 2004, where he works in the areas of international sales and of electronic commerce. As secretary of UNCITRAL Working Group IV (Electronic Commerce), he oversaw the preparation of the UNCITRAL Model Law on Electronic Transferable Records. He is also active in the field of paperless trade facilitation and has contributed to drafting the Framework Agreement on Facilitation of Cross-border Paperless Trade in Asia and the Pacific. From March 2012 to November 2013 he was assigned as first Head of the UNCITRAL Regional Centre for Asia and the Pacific, located in Incheon, Republic of Korea. In his leadership, the BNU- UNCITRAL RCAP Joint Certificate Program on International E-Commerce Law was established in 2009, which organized the BNU High-Level Forum on International E-Commerce Law in 2014. He has published several articles and other materials on international trade law and comparative law, namely sale of goods, electronic commerce and trade law reform in developing countries.
24 September 2022, Professor Xue was invited to give a keynote speech on “AI-assisted Domain Name Dispute Resolution Mechanisms” at the 2nd International Conference on AI and Judicial Big Data, co-organized by Huazhong University of Science and Technology and Hubei High People’s Court. Prof. Xue discussed the ethical issue in deployment of AI in judicial proceedings and suggested that ADR (like domain name dispute resolution mechanism) may be more suitable area to implement pilot AI systems. AI may provide effective proceeding management for domain name dispute resolution, including receiving and servicing the Parties’ files, verifying the Parties’ identities and organizing cross examination. AI selection of adjudicators may considerably minimize the bias and prejudice and better serve the goals of independence and impartiality. Although AI cannot substitute the adjudicators’ judgement and discretion, it can be very valuable to verify the basic facts such as the information of the Applicant’s trademark registration and/or the Respondent’s domain name registration. It can help the adjudicators to complete the fact checking in the expedited proceedings. Domain name dispute resolution mechanism that is already networked, digitized and standardized can easily adapt to automation powered by AI. In addition, its characteristic of non-exclusive to judicial remedy is another layer of guarantee for AI pilot implementation.
